A software engineer in South Korea is why. He asked a question I haven’t been able to shake: if Homo sapiens hands off the thinking to something outside itself, can we still call it Homo sapiens?
That question sent me looking for what the term actually means. Which led me to a Swedish botanist, an AI that accidentally called itself human, and a TV show that saw all of this coming before any of us did.
This week’s piece is not about whether AI is conscious. It’s about what happens to us, and to our organizations, when we can’t answer that question. And we can’t.

Dutch regulators hit Uber with €825M fine for AI-driven driver deactivations without human oversight.
The Dutch Data Protection Authority issued its second-largest GDPR penalty after finding Uber suspended driver accounts through automated systems without adequate warning or human review. The ruling applies to any company using AI to make employment-impacting decisions about EU-based workers. Uber disputes the findings and plans to appeal, but the precedent is set: automated decisions with major consequences require human involvement.
Deadline: In effect now. Enforcement active.
Risk: Fines scale by violation count. Class action exposure follows regulatory action. The same driver group is now pursuing compensation claims.
