DOJ hits OpenAI with $3.2M settlement for discriminating against U.S. workers in hiring.
The Justice Department's Civil Rights Division secured a $3.2M settlement after finding OpenAI violated the Immigration and Nationality Act during its Permanent Labor Certification (PERM) hiring process. The company allegedly discouraged U.S. applicants by requiring paper applications (while accepting electronic submissions for other roles), advertising jobs on late-night radio, and omitting PERM positions from its public careers page. The settlement includes $1.2M in civil penalties plus $2M in back pay for affected workers.
Deadline: In effect now. OpenAI must immediately post PERM positions on its public career site and accept electronic applications.
Risk: This is the thirteenth settlement under DOJ's revived Protecting U.S. Workers Initiative. Companies using PERM sponsorship face scrutiny for any recruitment practices that appear designed to exclude U.S. candidates.
