THE POLICY CORNER
Five US jurisdictions now enforce AI hiring audits, compliance deadlines have passed.
New York City, California, Illinois, Texas, and Colorado all have active AI hiring regulations requiring employers to conduct bias audits, disclose AI use to candidates, and maintain documentation. NYC's Local Law 144 has been live since July 2023. Illinois and Texas took effect January 1, 2026. Colorado's SB 24-205 activated June 30, 2026. These laws apply to any employer using AI to screen or rank candidates for roles in those jurisdictions, regardless of company headquarters.
Deadline: In effect now across all five jurisdictions.
Risk: NYC fines run $500-$1,500 per violation, per day, per affected applicant. Multiply that across a hiring funnel and compliance failure becomes nine-figure liability. Plaintiff firms are already building class action cases.
Your move: Audit every AI tool touching your hiring pipeline this week. Confirm your ATS and screening vendors can produce independent bias audit documentation. If they can't, you need a new vendor or a manual workaround before your next job posting goes live.
