Musk accused of data theft…again

Our Report: Following a court injunction, filed by the Irish Data Protection Commission (DPC) last week, over Elon Musk using X (formerly Twitter) users' data to train his AI chatbot (Grok) without consent, a Vienna-based privacy campaign group—NOYB (None Of Your Business)—has also now lodged complaints against X—in nine EU countries—for “unlawfully” stealing user’s data to bolster its AI, without consent.

🔑 Key Points:

  • According to NYOB, X has been “irreversibly feeding” the data from over 60M EU users into Grok, “without informing them or asking for their consent,” also raising concerns over what will happen with already ingested data.

  • They’ve filed complaints with data protection authorities in nine EU countries—including France, Italy, and Spain—called for a “full investigation,” and requested an “urgency procedure” to allow the authorities to move quickly.

  • They also slammed the DPC’s injunction against Musk, calling it “insufficient” as it “failed to question the legality” of the issue and hadn’t tackled the “core issue” as users can’t get X to delete “already ingested data.”

🤔 Why you should care: NYOB has taken several big tech giants to court over data protection issues and GDPR violations, the most recent being Meta, who were accused of doing a similar thing as X—processing user data to train AI, without consent—causing it to halt its AI expansion plans in the EU.

🔒 New AI robocall protections

Our Report: The US Federal Communications Commission (FCC) has proposed a new set of rules to protect consumers against AI-generated robocalls and robotexts and help them identify and prevent fraud.

🔑 Key Points:

  • The proposed rules require AI-powered callers and texters to disclose their AI nature, clearly, at the beginning of calls and texts—stating “I am not a real person”—to protect consumers from unwanted or illegal robocalls and texts.

  • The FCC classifies an AI-generated call as one that uses computational technology, ML, Large Language Models (LLMs), or predictive algorithms to create “an artificial or prerecorded voice or a text” to communicate with a consumer.

  • Fines will be issued if the disclosure isn’t made, and the proposed rules build on the existing ban—which came into force in February—which prevents callers from making AI-generated robocalls without consumer consent.

🤔 Why you should care: The FCC is desperately trying to curb the rise of untrustworthy robocalls—especially after residents in New Hampshire were scammed by a Robocall mimicking Joe Bidens’ voice telling them not to vote in pre-elections, earlier this year—and believes that complete transparency over whether a call has been made with AI will eliminate confusion, allow for the pre-screening of unwanted calls, and prevent fraud.

IMAGE GENERATORS

🎨 No cost DALL-E? 

  • OpenAI has announced that ChatGPT users (on the lowest tier) will no longer have to pay to use its AI image generator—DALL-E—but they will only be able to generate a maximum of two images a day.

  • If users want to generate more than two images, they will be prompted to subscribe to ChatGPT Plus, which allows them to generate up to 50 images, every three hours, on a $20-a-month subscription.

  • OpenAI is doing this to encourage more users to subscribe to paid-for subscriptions and is hoping that allowing users to create 2 images a day will give them a preview of what they could access on a paid subscription.
